Do You need to register a Company or LLC? If so how and is this Incfile the right choice for you?

BY Afolabi Oluwademilade , 10 June 2021 11:00 AM

It’s Saturday, and you’re seated around a bonfire with your pals, telling them about your brilliant idea. You’re ecstatic, they’re ecstatic, and even your best friend’s dog is ecstatic! So naturally, you would like to make things official after observing their reactions. So you spend the following several weeks coming up with business names until you find the one. It talks to you, it’s eccentric, and there’s nothing else like it. You know you want to create an LLC, but you’re not sure where to begin.

Isn’t that last sentence familiar? If this is the case, you are not alone! Incorporating a small business may sound hard and frightening, but it doesn’t have to be due to the plethora of business formation service providers available. However, this creates a second issue. Which one do you prefer? Is this company legitimately providing me free services? In the instance of Incfile, the answer is yes.

They are a company entity creation service provider that offers a great free plan (plus state costs) to assist entrepreneurs as they get started swiftly and easily.

IncFile Has Been Going Since 2004

Since its inception in 2004, IncFile has grown to become one of the most popular LLC creation websites, establishing over 250,000 corporations. Of course, several internet services may assist you in forming an LLC. Nonetheless, IncFile has carved out a special niche for itself in this extremely competitive business, lately surpassing Swyftfilings in popularity. This IncFile LLC service review covers all of the important factors to consider before utilizing their LLC service.

Incfile is an online legal services provider that assists small business owners in forming business entities, filing compliance paperwork, and filing taxes. Services are tailored to the state or states in which your company operates. Incfile charges a one-time, flat fee for services so that there are no retainers or long-term contracts to worry about.

The most well-known service provided by Incfile is business formation. Since its inception in 2004, Incfile has assisted over 250,000 businesses in establishing themselves. As a result, the Incfile team is well-versed in the entity creation requirements of all 50 states and Washington, D.C.

How do you register a company with Incfile?

Generally, their process is simple, and they provide tidbits during registration to help address your queries. They explain why they require certain information and what they intend to do with it.

They generate money, though, by selling upsells and add-ons (there’s always a but). While this isn’t always a negative thing, some of these are stuff you can obtain for free elsewhere or aren’t worth paying for, and they may not work for every sort of small business.

Now, let’s take a closer look at the Incfile platform, how to navigate it, and my own experience with it.

First, click the red “incorporate now” button or pick your filing state and business type from the dropdown list just below the navigation menu. You may then choose whatever bundle you want to go with.

Their silver plan is free (plus state filing expenses for the articles of incorporation) and is what I went with. However, they offer a platinum package for $299 and a gold package for $149. This webpage also informs you how much money you save by selecting a premium subscription over add-ons a la carte.

This is convenient because other “always free” business creation packages do not allow you to combine services and extras to save money.

After you’ve decided on a package, you’ll begin the entity formation process with Incfile. First, they want basic contact information, such as your:

  • Your name
  • Your email address
  • Your phone number
  • And your mailing address

Following that, you must supply details about the entity you are founding. This includes:

  • Your company name
  • The number of owners
  • The type of business
  • The purpose of the business
  • Your business address.

Because Incfile provides free business name verification, they inform you that they will ask you to pick something different if the name you choose is not available.

They offer you a premium service plan for an Employer Identification Number, banking resolution, operating agreement, contract templates, and express shipping when you click next. I decided not to upgrade because

  • You may obtain an EIN for free from the Internal Revenue Service.
  • Operating agreements vary depending on the type of business.
  • You may require express delivery or a small company bank account.
  • Legal papers are also affected by the type of business.

What are the different types of companies and the registration processes/admin involved in company registration?

Then you get to choose if you want Incfile to be your registered agent service for a year (for free). When you’re through with that, they have a variety of add-ons available, including:

  • An EIN ($70) - this is a free service.
  • A Bank of America business account (free) – if you don’t already have a small business banking account, this is a terrific option.
  • Express shipping ($25) – except if you want your documents right away, you probably don’t need to upgrade.
  • Free business tax consultation - taxes may be complicated, so it’s a great idea to set this up and talk with a tax specialist about being organized and filing taxes.
  • Business permits and licenses ($99) - you can do this research yourself, but if you’re short on time or aren’t certain what you need, this may be a decent alternative.

The story behind Incfile

The tagline of Incfile is “Where Business Begins,” which aptly represents this company. Since its inception in 2004, Incfile has assisted over 250,000 new businesses in getting established. In addition, you can use the service to create a new:

  • Corporation
  • Limited Liability Company (LLC)
  • Partnership (L.P. or LLP)
  • Non-profit corporation

Incfile is compliant with the laws of every state in the United States. Furthermore, they collaborate with government agencies to assist entrepreneurs in completing all of the essential requirements to establish a new company.

Incfile also provides a limited range of ongoing services, although their primary focus is undoubtedly on the inaugural formation process.

Why would someone use Incfile as compared to similar competitors?

I discovered several things about IncFile. So, I’d want to go through them with you to explain why they stuck out to me and the benefits they provide.

1. Price

Unlike rivals’ least priced plans, which cost around $79 plus the state filing charge, IncFile’s Silver plan just costs you the state filing fee, which we discuss below. While there are various upsells, most firms can utilize this guidance to ensure their company or LLC is properly established without further fees. We’ll discuss about upsells later in this article to help you decide if you want to perform them yourself or pay a little extra to have IncFile do them for you.

Assume you want Incfile to handle more of the formation work. In such a situation, they propose upgrading to premium plans and saving extra cash on value-added services that you would ordinarily have to pay the full price for if purchased separately. But, of course, you may also pick add-ons a la carte if you don’t require all a premium plan has to offer.

Establishing a business with Incfile begins with determining which package is best for you. What’s wonderful is that their entry-level bundle is inexpensive, costing $0 plus state fees. However, there are three packages to select from, namely- Silver, Gold, and Platinum.

Incfile offers a lot of value at all three tiers, including the fundamental capabilities seen in the picture below, which are included with whatever plan you pick. They did an excellent job putting these together, in my opinion.

While other incorporation services provide up to 50 distinct options on their websites, Incfile concentrates on the most important fundamentals to make things easy.

2. Lifetime Customer Service

Whether you booked your order recently or seven years ago, their customer service team will walk you through the entire process from beginning to end. They offer phone and email service Monday through Friday during normal business hours.

So, whether you have basic queries, in-depth queries, or want a fresh copy of something you filed months ago, their staff has you covered. They’re always just a few mouse clicks or phone calls away!

3. Analysis of the Availability of Company Names for Free

There is (almost) nothing worse than spending hours contemplating the perfect business name, establishing your LLC, and paying the state taxes only to discover that your name is already in use.

Incfile prevents this by comparing your name against the names of other registered firms in your state. In addition, they inform you throughout the signup process that they will contact you and assist you in addressing any problems or concerns with your business name.

4. They offer to be your Registered Agent.

Every LLC or company must have a registered agent in each state in which they do business. This might be you, another LLC member, or a third party.

A registered agent provides an address where legal papers and communications from state and federal authorities can be received on your behalf. Documents like summons, paperwork, a subpoena, or a notice of legal action fall within this category.

Hiring a registered agent also keeps your private address hidden from third parties (and the general public) and restricts the quantity of mail you get at home.

5. You may check the status of your order and filing online.

While this may seem obvious, many incorporation providers do not allow you to follow your order and file status. Incfile, on the other hand, allows you to follow the status of all your orders with only a few clicks.

The simplicity of usage alleviates some of the concerns that many individuals have during the formation process. You can relax knowing precisely where you are and where your paperwork is.

Comparison between Swyft Filings and Incfile

These companies act as intermediaries between you and your state’s registration agency. Here are some of the similarities and key differences between Swyft Filings and Incfile. The most significant distinction between these two LLC services is that Incfile offers a full year of registered agent service from any of their LLC creation packages, while Swyft Filings does not. Furthermore, IncFile is a free LLC service ($0), but Swyft Filings cost $49.
